TERMS AND CONDITIONS:

1. Age, Travel Insurance and Travel Documents

Participants must be 18 years or older by the starting date of the trip.
By submitting your deposit, you are responsible and confirm that:
You are 18 years old or older
You have valid travel and health insurance

You have all valid travel documents, including but not limited to:
- A valid passport (please double-check with your country of citizenship how many months of validity are required for entry into the Portugal)
- Visa (please double check with your country of citizenship if applicable)
- Passenger locator form (Only applicable if you travel to The Philippines)
- Vaccination certificates (please double check with your country of citizenship and your healthcare provider if necessary)

2. Role of LUNA SURF

LUNA SURF is a privately hosted trip, not a licensed tour operator. Luna Wolters is the host and organizer of the experience but does not function as a travel agency or tour company. You participate voluntarily and at your own risk.

3. Payment Terms

To secure your spot on any LUNA SURF Trip, a non-refundable deposit of €250 is required at the time of booking. The remaining balance must be paid in full no later than 60 days prior to the official start date of the trip.

Bookings made within 60 days of the start date require full payment at the time of booking.

The remaining balance must be paid in full no later than 60 days prior to the trip start date. If payment is not received by this date, LUNA SURF reserves the right to cancel the booking and retain the €250 non-refundable deposit.

All payment transfer fees and currency exchange charges are the sole responsibility of the participant.

4. Cancellations & Refunds

Trip cancellations must be submitted in writing via email to luna@lunasurftrip.com to be considered valid.

Cancellations made by the participant 45 days or more before the trip start date are eligible for a 50% refund of all instalments paid.

Cancellations made by the participant 44 days or less before the trip start date are non-refundable.

No-shows or early departures are non-refundable under all circumstances.

Please note that accommodations, activities, and services are secured and prepaid approximately 45 days prior to the trip start date. For this reason, we maintain a strict cancellation policy.

5. Force Majeure

In the event of circumstances beyond reasonable control (e.g., natural disasters, war, pandemics, government restrictions), LUNA SURF reserves the right to modify, postpone, or cancel the trip. LUNA SURF will not be liable for compensation in the event that obligations are affected by these Force Majeure Events.

6. Liability Waiver

Participation in the LUNA SURF trip is at your own risk, and you are fully responsible for your own safety and wellbeing. By registering, the participant confirms and agrees to release LUNA SURF and all affiliated third-party providers from any liability for:

Any delays, accidents, damages, inconveniences, additional expenses, or loss of enjoyment that may arise during your personal travel to the official meeting point.

Any delays, accidents, damages, inconveniences, additional expenses, or loss of enjoyment that may arise during the LUNA SURF trip.

Airline-related issues, including delays, cancellations, or lost baggage. You are solely responsible for addressing these directly with the relevant airline or authority.

Unexpected events such as transportation delays, service disruptions, ocean conditions, or climate-related impacts that may alter or affect the trip experience. Group airport transfers are scheduled for set times only. Participants are responsible for arriving at the designated pickup time and location. Alternative transfer times are not available, and LUNA SURF cannot be held responsible for missed transfers. Participants who miss the scheduled transfer are responsible for arranging and covering the cost of their own transportation.

Any injury, accident, or physical harm sustained while participating in activities such as but not limited to surfing, yoga, transportation, local excursions, or from exposure to natural elements (e.g., wildlife, plants, weather). Incidents involving rented vehicles, including accidents, injuries, fines, or legal consequences.

Any activities provided by third-party vendors, LUNA SURF is not responsible for their safety or performance, transport delays, accidents or any damages incurred from third-party services.

The participant is solely responsible for the use of any surf equipment provided by local instructors, and LUNA SURF acts only as a coordinator, bearing no liability for injuries, damages, losses, or additional costs; any damage to or loss of the equipment may result in charges from the local provider, which would be the participant’s responsibility.

Any illness, injury, death, damage, or personal loss, regardless of the cause, including but not limited to force majeure, accidents, personal decisions, negligence (your own or others'), or unforeseen events.

The loss, damage, deterioration or theft of the participants personal belongings or other issues that may occur during the trip or while transporting illegal substances in either country. The participant is responsible for own behavior throughout the trip.

Any disrespectful, unlawful, or culturally inappropriate actions, including violations of local laws or customs, may result in your removal from activities or the entire trip. LUNA SURF reserves the right to terminate your participation without refund in cases of negative behaviour, lack of cooperation, or anything that disrupts group safety or harmony.

7. Health & Medical Responsibility

By joining LUNA SURF, the participant confirms that:

You are in good physical and mental health, fit to join all trip activities.

You can swim and have the necessary fitness for ocean-based and outdoor activities.

You will inform LUNA SURF of any injuries, medical conditions, allergies, or limitations in advance.

LUNA SURF reserves the right to determine your eligibility for participation and to dismiss any participant if deemed necessary for the safety, wellbeing, or harmony of the group.

You are responsible for your own health, safety, and any medical costs that may arise. LUNA SURF does not provide insurance or cover any medical treatment or emergencies during or after the trip.

You understand this is an adventurous trip involving nature, surfing, and physical activities, including potential risks.

8. Accommodation & Responsibility for Damage

Participants are responsible for their actions during the trip. If any damage is caused to the accommodation, whether accidental or intentional, or if any items are stolen or lost, the participant will be liable for covering the cost of repairs or replacement.

LUNA SURF is not responsible for any personal property that is lost, stolen, or damaged during the trip. Participants are advised to take appropriate precautions and ensure their belongings are secured at all times.

Participants are expected to respect the accommodation and its facilities. Any disruptive behaviour, vandalism, or misuse of property will not be tolerated and may result in removal from the trip without refund. Accommodation will be in a shared villa with a mix of queen beds and single beds. It is not guaranteed that each participant will have their own bed. You may be sharing a queen bed with another participant of the same gender.

Accommodation is reserved but may be subject to change due to unforeseen circumstances. In such cases, LUNA SURF will make every effort to provide alternative accommodation of equal standard and quality.

9. Behaviour & Conduct

LUNA SURF has a zero-tolerance policy for:

Disruptive, harmful, or disrespectful behaviour

Unsafe actions under the influence of alcohol or substances

Disrespect toward hosts, other guests, or local communities

You may be removed from the trip without refund if your behaviour jeopardizes the safety or harmony of yourself or the group.

10. Data & Media Use

By attending the trip, you consent to the use of photos and videos in which you may appear. These may be used for future promotion of LUNA SURF. If you do not wish to be photographed or filmed, please inform Luna in writing before arrival.

11. Amendments

LUNA SURF reserves the right to modify these Terms & Conditions. Updated versions will be sent to participants via email.

12. Payment Processing Disclaimer

LUNA SURF does not control or take responsibility for the security, failure, or error of any third-party payment processor (e.g but not limited to, Bank transfer).
